Policy and Standards
- Contribute to the development, implementation and maintenance of global privacy policies, procedures and guidelines and promote good data privacy standards globally.
- Maintain current awareness of evolving data protection and privacy legislations and laws of jurisdictions where the Bank has presence and contribute to the revision of the global privacy programme to ensure it remains effective in meeting the expectations of laws, regulations, and/or Bank's policy.
- Oversees the evaluation of enterprise privacy risk assessments, privacy compliance and privacy performance metrics.
- Developing and augmenting internal personal data governance by monitoring the relevant legal, regulatory and policy developments.
- Collaborating with external stakeholders and attending appropriate privacy and data protection meetings, conferences and symposia and to be abreast with good industry practices on data protection and privacy.
- Early anticipation, identification and mitigation of privacy risks in relation to technology transactions, outsourcing, marketing and other technology-driven projects and escalating such risks and governance issues in accordance with the Bank's risk management framework.
Advisory and Risk Assessment
- In conjunction with other members of the DTO LC team, and the wider LC community, provide advice to internal clients on all aspects of local and international laws concerning privacy, data protection and information security policies and practices.
- Support the Global Privacy Officer and the Head of DTO LC for Data to advice on data protection and banking secrecy/confidentiality issues
- Provide specialist advisory support to country and product legal teams on banking product or customer related transactions which have a data protection and privacy dimension.
- Reviewing, advising, drafting and negotiating of applicable data protection and privacy language in agreements with the Bank's vendors, customers and partners.
- Providing strategic and pragmatic advice and support to the Bank in respect of all group wide initiatives which touch on data protection and privacy.
Implementation and Training
- Disseminate the global privacy policies, in partnership with business lines, information technology and other relevant departments and in consultation with country LC officers and business managers.
- Contribute to the development and maintenance of a monitoring and auditing programme in the region, ensuring coordination with other business functions carrying out these activities.
- Support the DTO LC leadership team in raising awareness and providing training to staff on legal and compliance risk issues arising in the area of data protection and privacy.
Partnership/Collaboration
- Work with business and/or country LC colleagues to ensure that privacy and data protection requirements are effectively integrated into applicable business processes and supported by associated information systems and service providers.
- Builds relationships with other members of the DTO LC team across all geographies, and relevant stakeholders in GTO, the LC organisation and in other risk functions.
- Endeavours to keep all relationships on a strong professional and collegial footing.
- Endeavours to take a holistic approach to the management of risk - the legal issue may not be the most pressing risk issue.
Technical Knowledge and Qualifications
- A minimum of 5+ years of experience in advising business on data protection and privacy laws and regulations across multiple jurisdictions.
- Qualified lawyer in a common law jurisdiction, preferably England, Singapore or Hong Kong.
- Experience in data protection and privacy compliance and legislation monitoring gained in an international private practice or equivalent in-house.
- Experience and in-depth knowledge of cross-border data transfer issues in Europe and Asia-Pacific and working with policymakers and regulators in these regions.
- Possesses core technical knowledge in laws and regulations applicable to data protection and privacy in particular as they relate to the financial services sector inSingapore, Hong Kong, theUnited Kingdomand/or the European Union.
- Some experience of working with the financial services sector whether in private practice or in-house is desirable.
- Possess Asian language skills. Any other language skills are a plus.
Leadership skills
- Ability to engage and partner with senior business at a global level, both to deliver value added service and to represent the LC function.
- Ability to partner actively with country LC, Global Sourcing, GTO and as necessary other legal teams on data protection and privacy-related matters.
