Compliance Manager – Special Servicing (CMBS) recruitment
The Role:
You will support the organisation in ensuring relevant and comprehensive policies and procedures are in place to manage all aspects of risk and compliance within the servicing business and undertake sufficient and representative testing to evidence that these are being applied appropriately. In addition you will ensure compliance is part of the culture and maintain the department as a centre of excellence within the business.
This role will assist the Special Servicing Department with client operational activity and risk management.
Main responsibilities include:
- Manage all aspects of Legal and Regulatory compliance.
- Conduct periodic risk assessments and formulate response plans.
- Formulate and implement the compliance programme and report on a regular basis on the progress of implementation.
- Review on going policies, procedures and practices with a view to developing and implementing revisions and new guidelines.
- Coordinate and participate in internal compliance review and monitoring activities, including periodic reviews of departments.
- Enforce standards through well publicised disciplinary guidelines and develop policies addressing dealings with sanctioned individuals.
- Provide services on regulatory analysis of transactions and activities.
- Establish methods to improve efficiency and quality of services in order to reduce Hatfield Philip’s vulnerability to fraud and abuse.
- Develop, coordinate and participate in a multifaceted educational and training programme that focuses on the elements of the compliance programme and seeks to ensure that all appropriate employees and management are knowledgeable of, and comply with, pertinent standards, including particularly Data Protection and Anti-Money Laundering.
- Document contractual compliance requirements (servicing agreements) and monitor their fulfilment.
- Advise senior management on compliance laws, rules and standards, including keeping them informed of developments in the area.
- Develop and/ or update Compliance Manual.
- Develop effective communication of compliance policy.
- Research regulatory reference materials and obtain advice from regulatory agency staff, legal counsel or industry groups/ professionals.
- Act as contact point for compliance queries from staff.
- Support the yearly Servicer rating process.
- Work with Special Servicing Asset Managers to provide support and compliance functions.
- Work in tandem with Special Servicing department to ensure their loan strategies are consistent with HPI’s contractual obligations and the Loan Documents.
You will possess the following:
- Knowledge of UK and European regulatory requirements.
- Familiarity and the ability to read and understand complex legal agreements, including corporate contracts, loan and related security documentation.
- A working knowledge of Commercial Mortgage Backed Securities, including property law, accounting terms and financial principles.
- Understanding of loan syndication and securitisation an advantage.
- Understanding of lease structures and property cashflows desirable.
- Experience of reviewing legal documentation, organising audit processes, managing compliance databases and implementing new policies and procedures.
- Experience of commercial property loans gained through a banking or servicing background desirable.
- Ability to take the initiative and drive the setting and attainment of high standards.
- Ability to work independently and take independent views as appropriate.
- Sounds judgment of what is important.
- Constructive approach to risk control issues.
- Strong analytical and organisational skills.
- Ability to communicate clearly and work closely with colleagues, giving advice where necessary.
- Ability to communicate with staff at all levels including senior staff.
- IT skills including Word and Excel.
- Degree level qualification.
- Legal and / or banking qualification an advantage.
