Purpose of the Role
- Support the strategic plans of Coutts Asia businesses through the leadership of Compliance Surveillance function in monitoring regulatory risk oversight, advisory of regulatory rules and guidelines, second-line of defence (SLOD) testing and assurance, and participation in global Compliance initiatives.
- To effectively manage the Surveillance team in Asia through the development and maintenance of risk-based surveillance plans, surveillance framework (methodology, reporting documentation requirements), compliance risk assessment framework, advisory regulatory support, new products development and other bank-wide initiatives. This will also include acting as a regional liaison to surveillance teams at Divisional and Legal Entity levels.
- Support the Head of Compliance, Asia, Divisional Head of Compliance and CRO Asia, in ensuring that key stakeholders and senior management are apprised of key Compliance matters particularly in the area of surveillance and compliance risk assessments and assist in investigation works and actions towards effective risk management.
Key Accountabilities
- The role is responsible for the Coutts Asia’s Compliance Surveillance covering all markets and jurisdictions in which it operates within Asia, as the second line of defence. Responsibility covers the design, implantation, reporting and follow-up of the surveillance programme.
- Implement the divisional annual surveillance plan and maintain the surveillance framework that is fit for purpose for the various relevant business areas in Asia.
- Design, surveillance strategies implement and manage technical, system, process enhancements in relation to the surveillance framework so as to achieve internal and external requirements.
- Formulate and maintain the Compliance Risk Assessment programme, integrating with the Compliance surveillance framework to effectively manage the regulatory risk exposure of the bank.
- Assist with the bank’s adherence to all applicable financial services legislation and regulations, codes of best practice of the Wealth Division and RBS Group Polices.
- Challenge stakeholders, during the process of reviews, monitoring or otherwise, to ensure that business is conducted in line with relevant laws and regulations.
- Develop robust and timely Surveillance risk reporting to enable sound divisions by the Divisional, Regional and Location specific Management and Risk teams at various forums within the firm.
- Conduct trainings or briefings on surveillance trends, observations or issues to business partners to foster a more collaborative relationship.
- Support the Head of Compliance Asia with new regulatory requirements implementations, compliance risk assessments, and recommending appropriate control action to meet the RBS Group and local regulatory framework and practices. Recommend changes where necessary, to mitigate regulatory risk exposure.
- Provide assurance of Compliance surveillance standards to the Head of Compliance Asia, Chief Risk Officer Asia, Asia Management, and at Wealth Executive Management, and Group Management.
- Spearhead Compliance Asia’s various initiatives, investigations and programmes, including portfolio reviews and special reviews, as directed by Asia Head of Compliance.
- Be the champion and leader of the Compliance Surveillance’s Second Line of Defence, in engaging with First or Third Line of Defence’s processes, issues and conflicts.
- Evaluate and escalate to the senior management in a timely and effective manner the impact of changing laws and regulations to the operations of the Bank.
- Collaborate effectively across the functions and jurisdictions on initiatives, projects in fostering a strong compliance culture in Asia whilst assisting the growth of a quality business operation.
- Provide effective leadership of the Compliance Surveillance team through knowledge inputs, guidance, coaching, and training and development opportunities to ensure retention and continuing professional development of surveillance engagements, functional responsibilities and business undertakings.
- Delivery of all relevant Surveillance operations within budget.
The Individual:
- 10+ years experience in Compliance or Regulatory Risk in a private bank or financial services environment.
- Extensive working knowledge of relevant regulatory environment, including active interface with regulatory bodies’ within jurisdictions we operate.
- Ability to act proactively to ensure Compliance risk management is up-to-date and meets the needs of a dynamic market environment.
- Thorough knowledge of the Asian countries which constitute Coutts Asia’s key markets, including familiarity with legal and capital markets infrastructure of each jurisdiction as well as knowledge of regulatory, compliance and anti-money laundering regulations.
- Good verbal and written communications.
- Ability to identify and analyse problems and provide solutions.
