Specific Job Description Work directly with technology and business leaders to develop value-driven IP strategies early in the business and/or technology (product development) planning process, in order to positively affect product development efforts and potential sales, including identifying and monitoring competitive activity and researching market conditions or industry changes. Facilitate the identification and exchange of technology information useful for synergies among appropriate functional areas. Assist in planning and developing an IP portfolio (both domestic and foreign) that supports the processes involved in acquiring, developing, protecting and perfecting trade secrets, trademarks, patents and other intellectual property rights and interests. Develop and implement an infrastructure (e.g., software tools and repeatable processes) to support IP strategies and activities throughout the organization. Provide IP training and education for relevant functional areas. Identify licensable technologies early in the business and/or technology planning process and develop the business case for licensing the identified technologies and drive a process to generate license revenue from the identified technologies. Implement a watch service for collection and auditing of outside license royalties when appropriate. Position will report directly to Vice President General Counsel, with dotted line reporting to the Vice President of Business Development and Advanced Programs. Standard Job Description Manages a department providing legal advice and service on patent/intellectual property, copyright, or trademark matters including patentability of inventions, discovery, infringement of patents or copyrights, validity of trademarks, etc. Responsible for coordinating subordinate employee recruitment, selection and training, performance assessment, work assignments, salary, and recognition/disciplinary actions. Directs the preparation of files, and prosecution of patent applications to obtain broadest possible protection for company's inventions. Ensures all commercially important inventions are protected by valid patents and do not infringe valid third party patents. May oversee the appeal and interference proceedings. Renders opinions regarding infringement and validity of patents. May direct the negotiation and drafting of patent licenses and other agreements. Manages the evaluation of state-of-the-art searches and infringement searches. May participate in litigation. Typically has passed the U.S. Patent and Trademark Office examination for registration to practice. Has understanding of company's products and technology. Classifications require undergraduate or graduate science degree and law school (LL.B. or J.D.) degree and admission to practice in at least one state.
