JOB TITLE: Legal Adviser/Senior Legal Adviser

Position Summary
Reporting to the regional Head of Legal, the successful candidate is accountable for providing legal support to the business and other support departments in their daily operations and in their development initiatives, including providing legal advice on product development, customer transactions, and guidance on cross-border as well as domestic issues. He/she will also be responsible for drafting, advising and negotiating a broad range of futures and derivative transactions, company’s contracts and general issues affecting the company.
Core Responsibilities:
- Provide legal support for business and senior management on documentation and customer enquiries, as well as legal support for other departments on company’s contracts
- Electronic trading and related brokerage issues
- Drafting, advising and negotiating standard client agreements, vendor agreements and potentially, other futures and market standard derivatives documentation
- General contractual corporate and commercial matters
- Netting, capacity and authority issues
- Provide legal assistance on financial services regulatory matters
- Issues regarding collateral and margin
- Conflicts of law/cross-border issues
- Provide legal assistance on projects within Asia Pacific
- Provide legal advice on personnel and employment issues
- Assist with coordination of work and management of outside counsel
- Other duties or projects, as assigned
Day-To-Day Responsibilities:
- Provide legal assistance on general legal mattes, enquiries and projects as required
- Assist with client account documentation for standard and non-standard clients and jurisdictions, such as funds and other non-corporate entities and general advice in relation to exchange-traded derivatives activity
- Assist with OTC documentation such as FX and collateral documents, and potentially ISDA and related documents
- Act as a facilitator of business and interact extensively with senior management, front office traders, operations and customers.
- Develop and maintain quality relationships with colleagues in other Departments and Newedge offices
- Identify problems and opportunities, and recommend and implement appropriate solutions
- Assist Legal Department on other legal matters as necessary
- Obtain advice from external legal counsel where necessary in conjunction with Head of Legal, Asia Pacific
- Maintain up-to-date knowledge of legal and regulatory requirements
Requirements:
- Over 5 years post-qualification experience in Hong Kong or other common law jurisdictions is a must
- Sound background in private practice commercial/corporate/banking or in-house banking/brokerage
- Regulatory and/or litigation experience is a plus
- Knowledge of the operation of derivatives markets and products
- Knowledge of standard market documentation for exchange traded futures and OTC
- Commercially astute
- A team player, with a hands-on approach
- Confident and mature approach
- Highly motivated and flexible
- Ability to interact with front office and corporate staff at all levels with legal and regulatory requirements at forefront
- Ability to prioritise and manage demanding workload
- Effective verbal, written and communication skills
- Strong administrative and follow-up skills, with emphasis on detail
- Ability to gather facts, analyse information and recommend solutions
- Fluent in English, ability to read and write Chinese (Mandarin) or Japanese desirable
