Senior Commerical Specialist Job in Sacramento, California US

Position Summary

The Senior Commercial Specialist is a senior professional level position, reporting directly to the Commercial Manager. During the procurement phases, the Senior Commercial Specialist will support the Commercial Manager with preparation of the procurement documents, coordination of commercial documents with technical documents, and management of the procurement process itself. Once the P3 developers, Design/Builders and other construction contractors are selected, the Senior Commercial Specialist will support the Commercial Manager with contract administration/compliance monitoring and change management efforts. A primary task is to develop and administer practices to ensure that timing and level of submittal reviews/approvals, content/commitments in meeting minutes, etc., and other interactions with the P3 developers, Design/Builders and other construction contractors by the California High Speed Rail Authority’s (the “Authority”) design consultants and other submittal reviewers and inspectors are consistent with the contract terms, as well as with applicable Federal and State requirements. Another important responsibility is to track and manage contract costs and work progress to ensure timely and cost-effective project delivery. Duties include:

General

  • Development and ongoing implementation of procurement and contracting policies and procedures, and refinement of same as necessary.
  • Refinement and application of Construction Management Manuals.
  • Development and refinement of standard contract forms and other template contract and procurement documents.
  • Represents the Authority in meetings with proposers/bidders, contractors, oversight agencies, and other stakeholders, as required.
  • Other duties as assigned.
  • Procurement and Bid Packages

  • Work with technical staff and provide recommendations to the Procurement Manager regarding contract packaging approach

  • Preferred procurement/delivery methods
  • Preferred contract value
  • Preferred substantive breakdown (geographical limits, technical focus, trade classes, timing, etc.)
  • Preferred method of expeditiously and comprehensively complying with federal, state and local requirements (including SBE/DBE, labor, ADA, EEO, Buy America, CEQA/NEPA, etc.)
  • Assist during construction, D/B and P3 procurements, including:

  • Preparation of Requests for Qualifications and Proposals, or of construction Invitation for Bid packages
  • Preparation of Contract Documents
  • Management and coordination of proposer/bidder interface throughout procurement process
  • Evaluating Statements of Qualifications and Proposals
  • Construction and D/B Contracts; P3 Agreements

  • Monitor contractor/developer compliance with contractual requirements, including

  • Bonds/guarantees
  • Insurance
  • Subcontractor approval by agencies
  • Contractual performance requirements tied to contractual incentives/disincentives
  • Federal and State requirements
  • Implement and report regularly on change control, claims management and mitigation for contracts
  • Assist with coordination and implementation details of dispute resolution processes.
  • Education Experience

    Bachelor’s degree in technical discipline, business or accounting; advanced degree in law preferred. A minimum of 15 years directly related experience involving formation and administration of contracts under federal and state regulations.

    Required Skills

    The successful candidate will possess excellent organizational skills and ability to meet deadlines, demonstrated success in analyzing and resolving a variety of procurement and contractual issues, including those related to procurement documents and process and change-related correspondence, and expressing positions regarding same, both verbally and in writing. The preferred candidate will have experience working with public clients during traditional construction and design/build procurements, developing traditional construction and design/build procurement and contract documents, and managing delivery of public works transportation projects using these contract documents, ideally in the California statutory and regulatory context.
