SENIOR COUNSEL

The attorney in this position will work with the head of BMS patent litigation and other members of the BMS Intellectual Property Department to manage global patent litigations and patent-related disputes. Responsibilities include working with BMS Intellectual Property Department attorneys to develop and implement global patent litigation strategy, manage and collaborate with outside litigation counsel on all phases of patent litigation including pre-litigation activities, discovery, trials and appeals. Other responsibilities include managing global administrative actions including interferences, reexaminations and opposition proceedings. The attorney will also be required to advise company management on the status of litigations, independently meet with clients, review Intellectual Property issues, formulate strategies, and effectively communicate with BMS clients. The attorney should also have experience in all facets of Intellectual Property practice, including patent prosecution, counseling and transactional work.

The ideal candidate must have 8 or more years of patent attorneyexperience in chemistry or a mix of biotechnology and chemical practice, as well as strong academic credentials. The ideal candidate will have experience handling Hatch-Waxman ANDA litigation and knowledge of Hatch-Waxman litigation issues. The candidate must have excellent written and verbal communication skills, be a self starter, energetic, analytical, and have the ability to work well alone as well as part of a team. The successful candidate must also have excellent judgment and the ability to recognize legal issues and effectively communicate such issues to patent, legal, and general management. Domestic and international travel is required. J.D. and must be admitted to a state bar and admitted to practice before the U.S. Patent and Trademark Office.
