Senior Legal Counsel, Brand Protection & TradeMark Enforcement, GENEVA
The position is responsible for all aspects of the Company’s brand protection, anti-counterfeit and trademark protection and enforcement in Europe, the Middle East and Africa. The responsibilities include development and execution of integrated legal strategies in consultation with a variety of internal business leaders.
This will involve regular contact with external lawyers and consultants, as well as external governmental and non-governmental stakeholders. The ability to work autonomously, think and draft clearly, precisely and creatively will be crucial. The successful candidate must be enthusiastic, enjoy working hard and being challenged, and demonstrate sound judgment even in ambiguous situations.
Responsibilities
- Lead, develop and manage anti-counterfeiting and brand protection programs and initiatives in the EMEA region, including investigations, legal enforcement actions and litigation.
- Assist in developing, maintaining, renewing and protecting the Company’s trademark portfolio and other intellectual property rights, including managing and preparing trademark oppositions and evidences of use.
- Oversee and manage customs seizures, police and law enforcement inquiries
- Act as EMEA point of contact between the Company and outside counsel, enforcement authorities, investigators, IP organizations
- Lead and oversee online auction and web site monitoring programs; maintain white-lists of licensees; monitor for infringements; address repeat infringing sellers (e.g. refer to local law enforcement, serve with CD,…), etc.
- Lead, develop and manage intellectual property risk mitigation strategies and policies.
- Oversee and leverage enforcement programs at numerous national trade associations – insure that the targets are valuable, review litigation and law enforcement referrals, provide input on proposed strategies and priorities
- Work with and manage outside counsel in litigation against infringers and sellers of counterfeit goods.
- Assist in and take responsibility for other duties and special projects as assigned.
