Job Description:
This position is for the Tax Services Team in the BNY Mellon Asset Servicing business.
This position will report directly to the Head of EMEA Tax Services and it will be based in the London office.
The candidate will take a lead role in tax strategy, tax development and enhancement of tax services, identification of tax risks, client facing tax support and tax monitoring of our Asset Servicing Tax Services.
The candidate will work very closely with our Tax Services Team and all tax experts in the organisation, including Corporate Tax and Tax Operations teams to implement and review the tax services to meet legislation changes and to ensure compliance to relevant local tax requirements.
This position is a senior management position and will participate as a member of the BNY Mellon Asset Servicing EMEA Tax Committee.
Extensive experience will be required in the following areas:
- Custody Tax:
o Withholding Tax practices on securities, statutory tax and Double Tax Treaty analysis
o European Court of Justice tax cases impacting securities (e.g. Fokus Bank case)
o Capital Gains tax treatment of securities
o Analysis of tax transparent pooling structures
- Financial Transaction Taxes:
o Tax implications in the custody business, including settlements and corporate actions
o EU Financial Transaction Tax developments
o Local Financial Transaction Tax, including France, Italy, Portugal, etc.
- US Tax:
o Foreign Account Tax Compliance Act (FATCA) and InterGovernemental Agreements (IGAs) analysis
o 1099 and 1042 US Tax reporting
o Cost Basis reporting
o K-1 reporting and 1065 and PFIC reporting
o W8 and W9 Forms
Qualifications
The candidate will have a strong academic background in taxation and extensive professional experience in the financial services industry as a tax advisor or as part of a tax team in the Investment Services or Asset Management business.
