GENERAL PURPOSE:

This position is responsible for creating the global employee relations and compliance strategy, developing and implementing solutions through solid execution and oversight.  Position will establish key success criteria for function and be monitored through agreed upon performance metrics.    This position will provide leadership to a staff which also provides business-oriented legal advice and counsel regarding global employment and labor-related issues, policies, and programs to Human Resources professionals and line and corporate staff managers within the Company’s businesses. The function is responsible for the oversight of legal and compliance matters including but not limited to understanding all EEO, OSHA, FLSA, ADA, ADEA, FMLA, HIPAA, OWBPA, Title VII, NLRA, FCRA, FCPA, OSHA, COBRA, ERISA Workers Compensation, due diligence, legal compliance (including Sarbanes-Oxley), legislation research and analysis, labor relations, and policy development.

 

Ø       Adheres to SYKES policies on ethics and integrity.

Ø       Maintain an employment law department responsible for delivering high value, business-oriented employment-related legal advice to all areas of the company on all matters relating to corporate strategies, policies, procedures, and programs in the area of Human Resources.

Ø       Provide proactive advice and support to HR team to maintain a union free environment (where no unions exist) and direct activities to combat any union organizing drives.

Ø       Ensure the development of sound policies and programs in all areas of labor and employment, including wage and hour matters, hiring and recruiting, immigration, discipline, counseling and discharge, discrimination, wrongful termination, FMLA, reductions-in-force, union organizing efforts, drug testing issues, etc.

Ø       Create a proactive strategy to ensure compliance with existing and contemplated federal/state employment laws and regulations and work proactively and collaboratively to ensure necessary actions are taken.

Ø       Oversee the handling of all US employment litigation, including charges of discrimination; assessing risks and ensuring company interests are protected.Oversee the tracking of all employment-related issues and working with HR executives to analyze and resolve root cause issues. Direct and supervise outside US counsel handling employment litigation, including risk assessment, devising case strategy and serving as liaison for investigations, discovery, and other-litigation related tasks.

Ø       Ensure all Reduction-in-Force activity and separation agreements are based on sound business criteria and adhere to legally defensible processes. 

Ø       Responsible for monitoring and reporting on the Company's compliance and ethics program and in providing guidance for the Board and senior management team on matters relating to legal compliance.  Develops and implements policies and procedures in connection with the operation of the Compliance Program and its related activities to detect and prevent illegal, unethical, or improper conduct. 

Ø       Develop and periodically review and update the Code of Conduct and collaborate with other departments to direct compliance issues to appropriate existing channels for investigation and resolution.  Respond to alleged violations of rules, regulations, policies, procedures, and the Code of Conduct by evaluating or recommending the initiation of investigative procedures.  Provide reports on a regular basis, and as directed or requested, to keep the Board or Board Committee and senior management informed of the operation and progress of compliance efforts.  Ensure proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required.

Ø       May perform other additional duties and responsibilities as assigned.

 

 

QUALIFICATIONS

Ø       Maintains strong knowledge of all employment laws, trends and requirements.

Ø       Excellent client management and communication skills; both oral and written.

Ø       Excellent interpersonal and communications skills with the ability to work well in a fluid/fast-paced, highly collaborative, team environment.

Ø       Strong judgment and problem-solving skills with the ability to quickly assess potential for risk and opportunity.

Ø       Possesses strong work ethic and customer service orientation and ability to prioritize conflicting demands from multiple business clients

Ø       Experience providing legal support to company or business unit wide HR and business teams on all employment and labor-related issues, policies, and programs directly and via management of domestic and international outside counsel.

Ø       Experience managing, and directing outside counsel supporting, internal investigations, responses to EEOC and similar state agency complaints and employment litigation.

Ø       Experience interfacing with government and/or labor and employment agencies with  jurisdiction over employment and labor-related legal matters

Ø       Ability to work effectively with all levels of management, to manage multiple projects simultaneously, exercise sound judgment and work independently and efficiently, and meet deadlines with consistently high-quality work product in a fast-paced environment.

EDUCATION and/or EXPERIENCE

 

J. D. from an accredited law school, and must be in good standing with the Florida State bar.  Ten or more years of substantive law firm and/or in-house legal experience, with at least five years in-house strongly preferred.  Previous experience with preventive management of litigation risk, maintaining a union-free environment, all aspects of Labor Relations/Employment Law and managing AA/EEO programs.  Extensive experience in compliance oversight and reporting required.
