Description

Job Purpose:

Responsible for guidance and advice to clients in all aspects of compliance as governed by the Financial Services Authority Handbook (COLL/FUNDs) of rules and guidance, the Financial Services and Market Act 2000 and the OEIC Regulations 2001, and scheme documentation for open-ended and closed-ended structures. In addition, giving guidance and advice on unauthorised funds (including Charity Investment Funds) as governed by the appropriate scheme documentation (trust deed, memorandum and articles of association or operating memorandum). As part of a team ensuring that the AFM receives a high quality regulatory advice and a service commensurate with any agreed service level.

The jobholder has discretion in terms of decision making with regard to the undernoted list of principal responsibilities. It is the jobholder's responsibility to escalate to the Head of Regulatory Technical.

Responsibilities:
- Ensure sufficient priority and focus is maintained on investor protection issues in all regulatory decisions taken, changes to processes and remedial actions
- Provide a high level of technical expertise/practical and constructive advice to the client
- Provide a high level of technical expertise/practical and constructive advice to all Trust Depositary (TD) staff
- Review and provide comments on all scheme documentation in relation to fund launches, changes, transfers, fund mergers and terminations
- Assist/complete appropriate forms for submission to the TD Deal Review Committee (DRC) as required
- Assist with the development, implementation and management of solutions, remedial processes and actions to address identified regulatory issues (real and potential)
- Review and advise on particular fund features/structures as necessary ie. performance fees, use of second Collective Investment Schemes, eligibility of structured products using embedded derivatives
- Initiate and control amendments to TD practices and procedures to reflect market/industry changes
- Identify significant issues and regulatory developments at client level and take action as appropriate including advice on new market initiatives
- Maintain a high level of regulatory and product knowledge
- Attend various industry seminars/workshops relating to regulatory developments, new trends, and products
- Prepare and deliver (or assist in the preparation and delivery of) regular Regulatory Updates to clients (either via service review meetings with the Client Management team or at client's request) or bespoke presentations to clients or TD staff as required
- Product and Marketing:
- Provide input for RFIs and RFPs as required
- Attend and participate in new client pitches as required
- Provide input for periodic Trust Depositary publications
- To have an understanding of the monthly monitoring output and other automated review processes.

Qualifications

Person specification:
- Ability to work under pressure and organisation skills
- Excellent attention to detail
- Excellent communication skills (both written and oral)

Technical Skills, Knowledge, Systems Knowledge (and associated skill level)
- In depth knowledge and experience of CIS - essential
- Experience in a Trustee Depositary role – preferable
- Possess industry experience with a custodian or fund manager in a client-servicing/operational role
- An understanding of the investment markets and their impact on the Trust Depositary business

Academic/Professional Qualifications (or equivalent qualifiers)
- Educated to degree level or equivalent
- Relevant professional business qualification – Chartered Institute for Securities Investment preferred
