ERISA attorney to support weath managment division

Position Description

Seeking a 6 + year ERISA/tax attorney to join the Morgan Stanley Wealth Management division's ERISA Law group. Attorney will provide legal advice and support for MSWM retirement products and services, primarily MSWM's various IRA account products, and advise on ERISA fiduciary/prohibited transaction issues.

Responsibilities include:

(a) legal support for IRA/retirement brokerage accounts (qualified tax), including (i) drafting of IRA documentation (plans, disclosure statements and adoption agreements), (ii) work regarding MSWM's "non-bank custodian" status, and (iii) tax-reporting issues and remediations.

(b) IRC/ERISA fiduciary/prohibited transaction issues related to IRAs.

(c) ERISA legal support for Advisory products and services sold to IRAs (program changes/contracts/new product development), as well as brokerage IRA issues (e.g., sales of wrap advisory products, analyzing alternative investment issues).

Skills Required

Working knowledge of IRC Section 408, 408A and 4975 tax and prohibited transaction issues and ERISA exemptions required; knowledge of Investment Advisers Act helpful. Ideal candidate has an in-house private client, wealth management or financial services background and/or strong comparable law firm experience.
