Why this job is Awesome: TripAdvisor is looking to appoint a full-time, experienced Intellectual Property Counsel to assume full responsibility for the management and protection of the TripAdvisor Media Group’s (TAMG) intellectual property assets and to develop and implement strategic, tactical and operational policies and procedures to support TAMG’s intellectual property interests.

What You'll Do
• Work with management, marketing and design representatives and other business contacts to devise and implement IP strategies and processes throughout TAMG’s family of companies worldwide, and promoting integration of the IP function into the business; Assume overall responsibility for all IP issues affecting TAMG including:
• Trademarks– Managing our substantial trademark portfolio and prosecution matters globally (working through external counsel), advising on clearance and filing strategies, opposition and cancellation proceedings and co-existence arrangements. Manage relationships with external counsel and take responsibility for IP outside counsel budget.
• Domains – Manage our growing Domain Name Portfolio on a global basis
• Copyrights – Manage copyright issues related to the company's websites on a global basis, includes issues related to content acquisition, fair use, and publicity rights.
• User Generated Content– Manage legal issues and update the business on legal developments regarding user generated content (UGC) issues on a global basis, and their interactions with intellectual property issues.
• Infringement – Managing trademark, copyright, and design enforcement strategies on a global basis, working with other members of TAMG’s in-house legal team.
• Enforcement – Advising the business on the use and enforcement of trademarks, copyrights, trade secrets, designs and patents.
• Disputes – Manage pre-litigation disputes and litigation for IP matters. Negotiate settlements, working with business representatives.
• Patents – Manage Patent Prosecution and our developing Patent Portfolio, including developing strategies for expanding this portfolio. Experience preferred but not required.
• Marketing Commercial Law –
• Manage commercial contracts – negotiating, drafting and analyzing a wide variety of licensing, sales and development agreements, and non-disclosure agreements.
• Advise the Marketing team on all promotions, press releases, sweepstakes, contests, point of sale marketing and drafting product terms, conditions and disclaimers
• Advise the Marketing and Public Relations team on Advertising copy and review of marketing materials.
• Advise business clients, on the legal issues and risks, approval processes, company policies and procedures related to intellectual property and marketing law issues.
• Privacy – Advise on all aspects of global data privacy law and regulation, including data protection, data retention, and data security. Assist in continued development of our compliance efforts (data transfers, processing, privacy policies, and training). Experience regarding data privacy laws is preferable, but not required.

What We Seek:
• JD degree or equivalent with excellent academic credentials
• 5-10 years of professional experience, at least 2 of which are in-house, preferably.
• In-depth experience in intellectual property matters, marketing law, and contract law.
• Demonstrated experience advising clients in structuring complex commercial transactions, including new media content agreements.
• Strong organizational skills and the ability to manage several simultaneous projects under deadline pressure.
• Superior English communication skills, both verbally and in writing.
• Candidate must have strong academic and work credentials, the ability to draft and negotiate independently, excellent analytical, organizational and communication skills, and the ability to provide proactive and effective legal support in a fast-moving, in-house legal environment
